Why do you need to attend Family Dispute Resolution for Parenting Matters?

Participating in Family Dispute Resolution is now a mandatory step for parties prior to filing any application seeking parenting orders with a Court.  If parties still require the assistance of a court after attempting to resolve the issues via Family Dispute Resolution, the party wishing to file an application with the Court is required to file a copy of a certificate issued pursuant to section 60I of the Family Law Act (1975).
All of our panel Mediators are registered Family Dispute Resolution Practitioners with the Attorney Generals Department and are therefore able to issue the required certificates pursuant to 60I.

 

What are the different ways Mediation can take place?

Face to Face

In this model, the parties attend the same venue and are seated in the same room.  There are "break out" rooms for the parties to have some time with their lawyer to discuss options and proposals in private.

Via Telephone

Telephone mediations are similar to the face to face model in that the parties and mediator are all on the line together.  The parties then have time to have a private conversation with their lawyer to discuss options and proposals in private.  This type of mediation issuitable to parties who are restricted from attending the same venue due to things like distance, travel time, or there is some hostility that would make one or both of the parties feel uncomfortable being toegether in the same room.

Video Conference

Video conference mediations are similar to the face to face model in that the parties and mediator are all online together.  The mediator will send a link via email to the parties to connect to the video conference.  Aspire Mediation uses the "Zoom" platform. 

During the mediation the parties have time to have a private conversation with their lawyer to discuss options and proposals in private.   This type of mediations is suitable to parties who are restricted from attending the same venue due to things like distance, travel time, or there is some hostility that would make one or both of the parties feel uncomfortable being toegether in the same room.

Shuttle  

Shuttle mediations can take place at the same venue or via phone or video conference.  This type of mediation is suitable to parties who are restricted from attending the same venue due some level of hostility that would make one or both of the parties feel uncomfortable being toegether in the same room.  The mediator goes between the parties either by physically walking between the two rooms, hanging up from one party and dialing another or switching between video conference rooms.

Can you have a lawyer attend Mediation or Family Dispute Resolution with you?

Yes.  Lawyers are able to provide you with legal advice and assist with the development of legally binding consent orders or parenting plans.

Can you have a support person attend Mediation or Family Dispute Resolution with you?

You can have a support person attend with you, however, they will be reminded that their role is to support you and not to speak on your behalf.

Cost of Mediation

The cost of Family Dispute Resolution is usually shared by the parties.   *The fees below are for mediations that take place between 9am and 5pm Monday to Friday.  If you would like the mediation to occur outside of these hours or on a weekend please contact us for the relevant fee.

Parenting

Up to 3 hours of Family Disputes Resolution is *$1200 + GST ($1,320).  It is usual for parties to share this cost. 

This fee does NOT include any fees charged by your lawyer should you choose to have your lawyer attend with you.

Property

Up to 3 hours of Mediation is *$1,500 + GST ($1,650).  It is usual for parties to share this cost.

This fee does NOT include any fees charged by your lawyer should you choose to have your lawyer attend with you.

Parenting and Property together

Full Day - 10am to 4pm is *$2,000 + GST ($2,200).  It is usual for parties to share this cost.  This includes a lunch break of 1 hour.

  1. Intake form: Both parties are each required to complete their Intake Form and return it to our office with the payment of their share of the cost.
  2. Agreement to Mediate: Download and Fill in the Agreement - Family Dispute Resolution
  3. Balance Sheet. Property Mediations only.  The parties are required to provide a joint balance sheet when they return the intake form.  
  4. Financial disclosure.  parties are required to confirm that they have provided full and frank financial disclosure to the other party prior to the preparation of the joint balance sheet.
